Groundswell ("the Platform") is a business-to-business (B2B) advocacy campaign platform operated by Groundswell Campaigns Inc. ("we", "us", "our"). The Platform enables organizations to create, manage, and deploy advocacy campaigns including petitions, letter-writing campaigns, and other forms of civic engagement directed at government representatives.
By creating an account or using the Platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.

The Platform, including its design, code, features, and documentation, is the intellectual property of Groundswell Campaigns Inc. and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You retain ownership of the content you create and upload to the Platform. By using the Platform, you grant us a limited, non-exclusive licence to host, display, and transmit your content solely for the purpose of providing the service.
To the maximum extent permitted by applicable law, Groundswell Campaigns Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform. Our total aggregate liability for any claims arising out of or relating to these terms or the Platform shall not exceed the amounts you have paid to us in the twelve (12) months preceding the claim.
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We may suspend or terminate your access to the Platform at any time, with or without cause, upon reasonable notice. You may terminate your account at any time through the account settings. Upon termination, your right to use the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.
We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by posting the updated terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the revised terms.
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
